1. Acceptance of Terms
By accessing and using the Hibbing Speedway website (hibbingspeedway.com), purchasing tickets, participating in events, or subscribing to text message or email communications, you agree to be bound by these Terms of Use. If you do not agree, please discontinue use of this website and all associated services immediately. Hibbing Speedway is located in Hibbing, Minnesota and operates under the laws of the State of Minnesota.
2. Website Use & Intellectual Property
All content on this website — including but not limited to text, photographs, videos, graphics, logos, race results, and audio (podcast content) — is the property of Hibbing Speedway or its licensors and is protected by United States copyright and trademark laws. You may not reproduce, distribute, modify, or republish any content from this website without prior written consent from Hibbing Speedway management. Personal, non-commercial use such as sharing race results on personal social media with proper attribution is permitted.
3. User Accounts
Certain features of this website — including VIP Partner dashboards and competitor portals — require user accounts. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You agree to provide accurate and current information. Hibbing Speedway reserves the right to suspend or terminate accounts at its sole discretion for any reason, including violation of these Terms.
4. Online Purchases & Store
All purchases of merchandise, tickets, or other items through the Hibbing Speedway website are final unless otherwise stated at the time of purchase. Prices are listed in U.S. dollars. Hibbing Speedway reserves the right to refuse or cancel any order for any reason, including pricing errors. Event cancellations due to weather or circumstances beyond our control may result in rescheduled events; refund policies will be posted on a per-event basis.
5. Text Message (SMS) Communications
By submitting your phone number through our text list signup form, you consent to receive recurring automated text messages from Hibbing Speedway. Submitting your phone number does not guarantee you will be added to the text list. All submissions are reviewed before approval. Message frequency varies. Standard message and data rates may apply. You may opt out at any time by replying STOP. Reply HELP for assistance. Hibbing Speedway reserves the right to deny, remove, or revoke text list membership at any time for any reason.
6. Fan Code of Conduct
Hibbing Speedway is committed to providing a safe, family-friendly environment for all guests. By entering the facility or engaging with Hibbing Speedway online, fans agree to the following:
Respectful Behavior: Fans shall treat all drivers, officials, staff, volunteers, and fellow spectators with respect and courtesy at all times — both at the track and online.
No Harassment: Verbal abuse, threats, intimidation, discriminatory language, hate speech, or harassment of any kind directed at drivers, officials, staff, or other fans will not be tolerated.
No Violence: Physical altercations, fighting, or threatening behavior will result in immediate ejection from the facility and may result in a permanent ban and law enforcement involvement.
Substance Policy: Fans must comply with all applicable laws regarding alcohol consumption. Intoxicated individuals who pose a safety risk may be asked to leave the facility. Illegal substances are strictly prohibited.
Facility Rules: Fans must remain in designated spectator areas at all times. Entering the racing surface, pit area without proper credentials, or any restricted area is strictly prohibited and extremely dangerous.
Social Media Conduct: Fans who engage in cyberbullying, harassment, threats, defamation, or spreading false information about Hibbing Speedway, its staff, drivers, or officials on social media platforms may be banned from future events and removed from all communication lists.
Consequences: Hibbing Speedway reserves the right to eject, ban, or restrict any fan at any time for violations of this Code of Conduct. Refunds will not be provided to ejected individuals.
7. Driver & Competitor Code of Conduct
This Code of Conduct applies to all drivers, car owners, team owners, pit crew members, mechanics, spotters, family members, personal guests, sponsors, vendors, credentialed media members, social media page operators, influencers, content creators, bloggers, podcasters, and any other individual associated with, affiliated with, or present on behalf of a competing driver or racing team (collectively, "Team Affiliates"), whether physically present at the facility or not. This Code governs conduct at the track, in the pits, in spectator areas, online, on social media, and in any other public or private setting where the individual's actions affect Hibbing Speedway, its events, or its community. Every person entering the pit area, infield, or any restricted area under a competitor's or vendor's credentials is bound by this Code. The competing driver is ultimately responsible for the conduct of all Team Affiliates operating under their entry. Vendors operating on Hibbing Speedway property or in association with Hibbing Speedway events are independently bound by this Code and subject to the same consequences. All applicable WISSOTA and track-specific competition rules also apply.
Sportsmanship: Drivers and all Team Affiliates shall conduct themselves in a professional and sportsmanlike manner at all times — on the track, in the pits, in spectator areas, and online. Competitors and their affiliates represent not only themselves but also their sponsors, their teams, and the sport of dirt track racing. Unsportsmanlike conduct by any Team Affiliate may result in penalties assessed to the driver's entry.
Official Decisions: Decisions made by race officials, scorers, and track management are final. Disputes must be handled through proper protest procedures as outlined in the track rulebook. Confrontational, threatening, or abusive behavior toward any official — by a driver or any Team Affiliate — will result in penalties up to and including suspension of the driver and/or removal and banning of the offending individual.
Safety: All competitors must comply with all safety requirements, technical specifications, and equipment rules. Team Affiliates must follow all pit area safety protocols, including but not limited to wearing proper footwear, keeping children supervised, and obeying all flag and signal instructions. Failure to comply may result in disqualification, ejection, and suspension of pit access privileges.
Pit Area Conduct: The pit area is a restricted, working environment. Alcohol consumption by any active competitor or crew member during competition is prohibited. Any individual — driver or Team Affiliate — who is visibly intoxicated, behaving recklessly, driving at excessive speed in the pit area, or otherwise endangering the safety of others is subject to immediate ejection, disqualification of the associated entry, and potential suspension from future events. All individuals with pit access must possess the appropriate credentials and must remain in authorized areas.
Harassment & Threats: Verbal abuse, physical intimidation, threats of violence, discriminatory language, hate speech, or any form of harassment directed at officials, track staff, fellow competitors, Team Affiliates, or fans will not be tolerated from any driver or Team Affiliate. Physical altercations involving any Team Affiliate — regardless of who initiated the incident — may result in penalties assessed to all associated driver entries, immediate ejection, suspension, and law enforcement involvement.
Social Media & Public Conduct: All drivers, car owners, team owners, crew members, family members, sponsors, vendors, credentialed media members, social media page operators, influencers, content creators, bloggers, podcasters, and every other Team Affiliate as defined above must adhere to Hibbing Speedway's Social Media Policy (Section 8), including the Anonymous, Fake & Secondary Accounts policy. This obligation applies to personal accounts, team accounts, business accounts, fan pages, racing pages, anonymous accounts, fake accounts, secondary accounts, burner accounts, and any other social media presence — whether the individual is named, pseudonymous, or anonymous. Public disparagement, defamation, or false statements regarding Hibbing Speedway, its ownership, management, officials, staff, volunteers, fellow competitors, sponsors, or vendors — on any social media platform (including but not limited to Facebook, Instagram, TikTok, X/Twitter, Snapchat, YouTube, and Reddit), in public forums, group chats, podcasts, livestreams, media interviews, or through any other public or semi-public medium — may result in probation, loss of points, loss of purse money, suspension of competition privileges, revocation of pit credentials, removal from all text and communication lists, and/or a permanent ban from the facility. Using or directing another person to use a fake or anonymous account to circumvent this policy will be treated as a direct violation and subject to the most severe penalties. A Team Affiliate's social media conduct may result in penalties assessed directly to the associated driver's entry. Constructive feedback and concerns must be directed to track management privately.
Responsibility for Guests: Drivers are responsible for the behavior of every individual they bring into the pit area or who is present at the facility in association with their team. If a Team Affiliate is ejected from the facility for misconduct, the associated driver may also face penalties at the discretion of track management — up to and including disqualification from that event, loss of points, and suspension.
Event Participation & Communication Privileges: Acceptance to the Driver Text List and other track communications is based on active event participation and adherence to all track policies and this Code of Conduct. Entries, pit access credentials, communication list membership, and all competition privileges may be denied, suspended, or permanently revoked at the sole discretion of track management.
Consequences: Violations of this Code of Conduct by any driver or Team Affiliate may result in one or more of the following: verbal or written warning, fine, loss of points, loss of purse money, probation, disqualification, suspension (one or more events), permanent ban from Hibbing Speedway facilities and events, removal from all communication lists, and/or referral to law enforcement. The severity of consequences will be determined by track management and is not subject to appeal except through the formal protest process. Repeated or egregious violations will result in escalating penalties. Track management reserves the right to impose immediate and permanent bans for conduct that threatens the safety of any individual or the integrity of the sport.
8. Social Media Policy
Hibbing Speedway maintains an active presence on social media to engage with fans, competitors, and the broader racing community. The following applies to all fans, drivers, car owners, team owners, crew members, family members, sponsors, vendors, credentialed media members, social media page operators, influencers, content creators, bloggers, podcasters, and all Team Affiliates as defined in Section 7 — whether interacting with Hibbing Speedway's official accounts or posting about Hibbing Speedway on any third-party platform, personal account, team page, fan page, racing page, or anonymous account:
Respect: All comments, posts, messages, videos, and livestreams must be respectful. Hate speech, discriminatory remarks, threats, sexually explicit content, bullying, personal attacks, and spam will be removed and may result in blocking, ejection from the facility, and/or a ban from future events.
Accuracy: Do not post false or misleading information about Hibbing Speedway, its ownership, management, officials, race results, scheduling, policies, or personnel. Spreading rumors, misinformation, or unverified claims that damage the reputation of the track, its staff, or its competitors is a violation of this policy. If you have a question or concern, contact track management directly.
Drivers, Car Owners & Team Affiliates: All drivers, car owners, team owners, crew members, family members, sponsors, vendors, credentialed media members, social media page operators, influencers, content creators, bloggers, podcasters, and every other Team Affiliate as defined in Section 7 are held to an elevated standard on social media. You represent not only yourself but your team, your sponsors, and the sport. Content that disparages, defames, or harms the reputation of Hibbing Speedway, its ownership, officials, staff, fellow competitors, sponsors, or vendors — whether posted from personal accounts, team accounts, business pages, or anonymous/fake accounts — is subject to review and disciplinary action under the Driver & Competitor Code of Conduct (Section 7). This includes but is not limited to posts, comments, replies, shares, quote-tweets, stories, reels, TikToks, YouTube videos, livestreams, podcasts, and media interviews. A Team Affiliate's violation may result in penalties assessed to the associated driver's entry.
Anonymous, Fake & Secondary Accounts: The use of anonymous accounts, fake accounts, secondary accounts, burner accounts, pseudonyms, or any account not clearly tied to the individual's real identity to post disparaging, defamatory, harassing, threatening, or misleading content about Hibbing Speedway, its ownership, officials, staff, competitors, sponsors, or vendors is a serious violation of this policy. Hiding behind a fake or anonymous account does not shield any individual from consequences. If track management determines — through content, context, timing, screenshots, witness statements, IP information, or any other available evidence — that an anonymous or fake account is operated by or connected to a driver, car owner, Team Affiliate, vendor, or any credentialed individual, the identified person will be subject to the full range of disciplinary action outlined in Sections 7 and 8, including but not limited to immediate suspension of competition privileges, revocation of pit credentials, removal from all communication lists, and permanent ban from Hibbing Speedway facilities and events. Encouraging, directing, or knowingly allowing another person to post violations on one's behalf — whether through a fake account or otherwise — will be treated as a direct violation by the individual who encouraged or directed the conduct. Track management's determination of account ownership or association is final.
Vendors: Vendors operating at Hibbing Speedway events — whether on the grounds, in the pit area, or online — are expected to maintain professional and respectful social media conduct regarding Hibbing Speedway and all individuals associated with its events. Violations may result in revocation of vendor privileges and a ban from future events.
Photos & Video: Personal photos and videos from Hibbing Speedway events may be shared with credit. Professional or commercial use requires prior written permission from Hibbing Speedway. Hibbing Speedway reserves the right to use any photos or video captured at its facility for promotional purposes.
Monitoring & Enforcement: Hibbing Speedway actively monitors public social media mentions, tags, and content related to the track, its events, and its personnel. Content deemed harmful, defamatory, threatening, or in violation of this policy may be documented, reported to the relevant platform, and will result in consequences at the track level — including but not limited to removal from communication lists, loss of points, suspension of competition or vendor privileges, and permanent bans. The decision to enforce consequences rests solely with track management.
9. Assumption of Risk & Liability
Motorsports are inherently dangerous. By attending any Hibbing Speedway event, you acknowledge and assume all risks associated with attending a motorsports event, including but not limited to injury from racing vehicles, debris, noise exposure, weather conditions, and the actions of other spectators. Hibbing Speedway, its owners, officers, employees, volunteers, and affiliated organizations shall not be liable for any injury, loss, or damage to person or property arising from attendance at or participation in any event. This assumption of risk extends to all areas of the facility.
10. Limitation of Liability
To the fullest extent permitted by Minnesota law, Hibbing Speedway shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this website, attendance at events, or participation in any Hibbing Speedway program. Our total liability for any claim shall not exceed the amount paid by you, if any, for the specific service or product giving rise to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Hibbing Speedway, its owners, employees, volunteers, sponsors, and affiliates from any claims, losses, damages, or expenses (including attorney fees) arising from your use of this website, violation of these Terms, or any activities at Hibbing Speedway events.
12. Third-Party Links
This website may contain links to third-party websites, including sponsor websites, social media platforms, and partner services. Hibbing Speedway is not responsible for the content, privacy practices, or policies of any third-party websites.
13. Changes to Terms
Hibbing Speedway reserves the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting. Your continued use of the website constitutes acceptance of any modified terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles. Any dispute arising from these Terms or your use of this website shall be subject to the exclusive jurisdiction of the courts located in St. Louis County, Minnesota.
